This Privacy Policy describes how ELITE SEARCHERS S.R.L. collects, uses, stores, discloses, and protects the personal data of individuals who access the elitesearchers.ro website, of candidates, potential candidates, clients, potential clients, representatives of business partners, suppliers, and other individuals who interact with our company.
The website elitesearchers.ro is owned and administered by ELITE SEARCHERS S.R.L., a Romanian legal entity, with registered office in Bucharest, District 1, Str. Av. George Valentin Bibescu nr. 20-22, Bl. XI/1, Sc. 1, Et. 1, Ap. 6, registered with the Trade Register under no. J40/7182/2018, fiscal code (CUI) 39387680, hereinafter referred to as "Elite Searchers", "the Company", "we", or "the data controller".

In conducting its business, Elite Searchers processes personal data in accordance with Regulation (EU) 2016/679 on the protection of personal data ("GDPR"), applicable national legislation, and the principles of confidentiality, proportionality, transparency, and data security.
2. The role of Elite Searchers in data processing
In most situations, Elite Searchers acts as a personal data controller, establishing the purposes and means of processing data in connection with its executive search, headhunting, recruitment, selection, assessment, HR consulting, commercial communication, and business relationship management activities.
In certain specific situations, depending on the nature of the mandate and the contractual instructions of the client, Elite Searchers may act as a data processor or, as the case may be, as a joint controller. The specific role is established by the contractual documents concluded with the relevant client or partner.
3. Principles applicable to data processing
Elite Searchers processes personal data in compliance with the following principles:
- a) lawfulness, fairness, and transparency — data are processed fairly, legally, and in a transparent manner in relation to data subjects;
- b) purpose limitation — data are collected for specified, explicit, and legitimate purposes and are not further processed in a manner incompatible with those purposes;
- c) data minimization — we process only data that are adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed;
- d) accuracy — we make reasonable efforts to ensure that the data used are accurate and kept up to date;
- e) storage limitation — we keep data only for as long as necessary for the purposes of processing or as long as we are legally obligated to do so;

- f) representatives of clients, potential clients, suppliers, partners, and collaborators of Elite Searchers;
- g) individuals participating in interviews, assessments, professional discussions, selection processes, or consulting projects;
- h) individuals who interact with Elite Searchers through external platforms, including LinkedIn, email, phone, professional events, or business networks.
5. Categories of personal data processed
Depending on the relationship with the data subject and the purpose of the interaction, Elite Searchers may process the following categories of data:
Name, surname, email address, phone number, company, job title, department, city, country, public professional accounts (such as LinkedIn profile), necessary for communication.
Professional experience, positions held, previous or current employers, area of activity, seniority level, responsibilities, skills, certifications, education, qualifications, foreign languages, relevant projects, professional achievements, availability, salary expectations.
Information voluntarily included by the data subject in the CV, cover letter, portfolio, recommendations, LinkedIn profile, or other sent documents.
Interview notes, professional assessments, observations regarding role fit, professional motivation, career preferences, compatibility with client requirements.
Professional references, confirmations of professional history, provided by persons who can confirm the candidate's experience and competencies.
Name, surname, job title, company, professional email address, phone number, correspondence, contractual data, billing data, history of cooperation.
IP address, browser type, operating system, device used, pages visited, traffic source, online identifiers collected via cookies (according to Cookies Policy).
We do not actively request sensitive data. If voluntarily sent via CV or correspondence, we will process them only to the minimum extent necessary under an applicable legal basis.
6. Sources of personal data
Personal data may be collected:
- a) directly from the data subject, through forms, sent CVs, interviews, or direct correspondence;
- b) from public professional sources, including LinkedIn, company websites, articles, conferences, public registers;
- c) from clients, when they transmit information necessary for collaboration or recruitment;
- d) from third parties who provide professional recommendations or references;
- e) from partners or members of international networks;
- f) automatically via website visit (log files, cookies).
7. Purposes of data processing
Elite Searchers processes personal data for website operation, contact form management, executing executive search and headhunting mandates, interviews and candidate assessment, presenting shortlists to clients, maintaining the talent database, issuing invoices, bookkeeping, protecting the Company's rights, and legal compliance.
8. Legal bases of processing
Negotiating recruitment mandates, managing collaborations, or administering the contractual relationship with clients or partners.
Identifying suitable candidates for executive roles, professional contact, protecting website security, preventing fraud, and defending the Company's rights.
Keeping candidate data in the database long-term, transmitting the nominal profile to a client (when express consent is requested).
Bookkeeping, tax obligations, and fiscal reporting or legal audit.
9. Processing of candidate and potential candidate data
Within headhunting activities, we identify and contact individuals from public professional sources (LinkedIn). Initial contact is based on legitimate interest. Before nominal transmission of the CV or evaluation to clients, we inform the candidate and obtain their agreement.
10. Longlists, shortlists, and assessment reports
Analysis documents such as shortlists may contain detailed professional data. The client receiving this data is directly responsible for complying with GDPR obligations related to their exclusive use for the mandate.
11. Data recipients
Data may be disclosed to Elite Searchers' clients (under active mandates), IT/hosting providers, accountants, legal advisors, international partners (for transborder mandates), or public authorities under the law. **Elite Searchers does not sell personal data.**
12. International data transfers
Within transborder mandates, data may be transferred outside the EEA only under appropriate safeguards (EU-approved standard contractual clauses or adequacy decisions).
13. Data storage
- Contact Form / Emails: For the duration necessary to resolve the request + a reasonable period for records.
- CVs for Future Opportunities: Up to 3 years from the last relevant interaction or until a deletion request is made.
- Clients, Suppliers, and Contracts: For the duration of the contract + legal tax/accounting archiving periods.
14. Data security
We apply strict physical and digital security measures: limiting staff access, secure passwords, storage in secure servers, encryption in transit, confidentiality agreements with partners.
15. Confidentiality in executive search processes
Confidentiality is an absolute value for Elite Searchers. All mandates, candidate profiles, and client strategic plans are treated under absolute professional secrecy.
16. Automated decision-making and profiling
Elite Searchers does not make automated decisions with legal effects concerning you. All professional profile evaluations are performed by human input (senior consultants).
17. Rights of data subjects
Under GDPR, you have: right of access, right to rectification, right to erasure (right to be forgotten), right to restriction of processing, right to data portability, right to object, right to withdraw consent at any time, and the right to lodge a complaint with ANSPDCP.
18. Exercising rights

19. Minors' data
Our services are not addressed to minors. If we identify accidental collection of data from persons under 18, we will delete them immediately from our database.
20. Commercial and professional communications
We may send business communications exclusively based on valid legal bases. You can refuse/unsubscribe from these optional communications at any time.
